Personal Data Protection Notice (KVKK)

Proto Mass Spare Teknik Mühendislik Dış Ticaret Sanayi ve Ticaret Ltd. Şti. (hereinafter referred to as “PMS Teknik”) requests certain personal information from you (such as your name, age, areas of interest and email address) in order to better serve its customers, readers and followers in connection with its engineering, training, consultancy and trading activities, and with İşte İlham, the monthly digital business and entrepreneurship magazine of which it is the licence holder. This information, collected on the shared servers used by PMS Teknik, is used solely within PMS Teknik for periodic campaign work, for designing special promotional activities tailored to customer profiles, for informing you about these campaigns and commercial activities, and for customer “segmentation” work aimed at preventing unsolicited emails from being sent.

PMS Teknik never shares the information it collects through its membership forms with third parties without the knowledge of, or contrary to the instructions of, the member concerned; it does not use this information for commercial purposes for any reason outside its activities, and it does not sell it. Customer information may be disclosed to official authorities only where such information is requested by them and where PMS Teknik is obliged to make a disclosure under the mandatory provisions of the legislation in force.

Information on the Protection of Personal Data

At PMS Teknik, we attach great importance to processing and retaining your personal data in compliance with Law No. 6698 on the Protection of Personal Data (the “Law”). We would like to inform our customers about our purposes and methods for collecting, processing and transferring personal data, and accordingly about your rights under the Law.

Methods of collecting personal data

As the data controller, and within the framework of our legal obligations arising from the legislation, PMS Teknik collects your personal data verbally, in writing or by electronic means — orally, through our website, social media channels, mobile applications and similar means — for purposes such as enabling you to benefit from the services of our brands, informing you about our campaigns with your consent, recording your suggestions and complaints, establishing better service standards for you, and determining and implementing PMS Teknik’s commercial and business strategies.

Personal data obtained lawfully before the Law on the Protection of Personal Data came into force are also processed and protected in accordance with the terms and conditions set out in this document.

Processing of personal data and purposes of processing

As the data controller, PMS Teknik may — through our call centres, written communication channels, social media pages, mobile communication channels, in-store communication channels and/or any other channels, without being limited to these — wholly or partially obtain, record, retain, store, modify, update, periodically review, reorganise and classify the personal and/or special categories of personal data obtained with your consent; retain them for as long as necessary for the purpose for which they are processed or for the period stipulated in the relevant law; share or transfer them, where required by law or by actual service-related needs, with the private and legal persons PMS Teknik works with, with the public institutions and organisations to which it is legally obliged, and/or with relevant third-party natural or legal persons resident in Türkiye or abroad; and transfer them abroad where required by law or by actual service-related needs. We hereby inform you that we may process your personal data for purposes such as enabling PMS Teknik’s customers to benefit from the services of our brands, informing you about our campaigns with your consent, recording your suggestions and complaints, establishing better service standards for you, and determining and implementing PMS Teknik’s commercial and business strategies, and in all cases in compliance with Law No. 6698 on the Protection of Personal Data and the related legislation.

Transfer of personal data

PMS Teknik may share your personal data only on the basis of your explicit consent, or — provided that adequate measures are taken within the framework of the security and confidentiality principles set out in the Law — within Türkiye, and — provided that the necessary security measures are taken — abroad, for the purposes of conducting the Company’s activities, establishing the business relationship between data subjects and our customers and/or holding negotiations for this purpose, offering services, opportunities and facilities, and improving service quality; with our group companies, our business partners, the customers with whom we have agreements and to whom we provide services as required by our activities, suppliers, audit firms, or public institutions or organisations authorised by law to request such data, and other relevant authorities, without being limited to these.

Rights of the data subject under Article 11 of the Law on the Protection of Personal Data (the “Law”)

PMS Teknik will respond to the following requests of data subjects:

• to learn whether PMS Teknik processes personal data relating to them and which personal data it processes;
• to request information on the purposes of the processing;
• to know the third parties in Türkiye or abroad to whom PMS Teknik transfers personal data;
• to request the rectification of personal data that are incomplete or inaccurately processed;
• to request the erasure or destruction of personal data in accordance with the Law;
• in the event of a request for rectification, erasure or destruction, to request that the third parties to whom the personal data have been transferred be notified of the actions taken;
• to object to a result arising against them through the analysis of the processed data exclusively by automated systems; and
• to obtain a copy of their personal data.
